Overview
Millie joined chambers in October 2022 on successful completion of her pupillage. Millie has fast developed a broad commercial chancery practice, with a particular focus on private client and property disputes, both domestic and offshore. This is dovetailed by Millie’s commercial and insolvency practice, which gives her an edge when it comes to complex disputes engaging multiple and overlapping areas of law.
Millie has been praised as a deft advocate, regularly appearing in her own right in the High Court and County Court. She recently acted as sole counsel for the successful claimant in a 5-day trial of a TOLATA claim. Millie has also appeared unled in the Court of Appeal.
Millie is currently seconded to the Private Wealth Disputes team of Fladgate LLP. During her time there, Millie has worked on a range of high value and complex trusts and probate disputes, including assisting in the seminal case of Al-Thani v Al Thani.
Before coming to the Bar, Millie obtained a first-class degree in Law from University College London. Outside chambers, Millie is a keen linguist and is currently learning Japanese.
Trusts, Wills & Estates
Millie regularly assists with and has experience of matters including:
- Applications for the removal of trustees/executors.
- Contentious probate claims (undue influence, knowledge and approval, lack of testamentary capacity etc).
- Associated claims by and against estates e.g. common intention constructive trusts, proprietary estoppel, possession, accounts.
- Claims under the Inheritance (Provision for Family and Dependants) Act 1975.
- TOLATA proceedings.
- Non-contentious procedures including limited grants, caveats, warnings, appearances, and summonses.
- Appearing in the Court of Protection on trusts and estates matters.
Millie’s recent instructions include:
- Acting for the successful claimant in a 5-day trial of a ‘sole name’ TOLATA claim between former co-habiting partners.
- Successfully obtaining an order for the removal of an executor and denial of the executor’s indemnity.
- Assisting Mark Hubbard in complex high-value trusts litigation spanning several jurisdictions, including England & Wales, Guernsey, and the Isle of Man.
- Advising a trustee in relation to and obtaining the blessing of the Court for a momentous decision they have made.
- Advising on the merits on 1975 Act claims against estates for reasonable financial provision.
- Advising on securing estate assets in a multi-jurisdictional administration.
- A professional negligence claim against solicitors with respect to failure to sever a joint tenancy of land.
- Advising on the liquidation of a corporate trustee.
- Advising on proprietary estoppel claims against estates.
- Advising as to the intersection between trusts and insolvency.
- Advising the descendants of a former prime minister as to the correct interpretation of a will and as to a potential professional negligence claim.
- Application to the Court of Protection for the revocation of an LPA and for the appointment of an independent attorney.
Property
Millie has experience of the full range of chambers’ work in real property and landlord and tenant matters, including possession claims, mortgages, and business tenancy renewals. Millie is well-equipped to deal with property disputes engaging elements of insolvency/trust law.
Millie’s recent instructions include:
- Defending a proprietary estoppel claim.
- Drafting an application for and obtaining an interim possession order against squatters of commercial premises.
- Defending possession proceedings with issues of locus standi and sub-tenancies.
- Advising a company on a commercially viable settlement of several possession claims.
- Successful 2-day trial of a boundary dispute.
Insolvency
Millie has experience of all aspects of personal and corporate insolvency and regularly appears in the County Court and Insolvency and Companies Court for various insolvency applications.
Millie’s recent experience and instructions include:
- Claims against errant directors under the Companies Act for breach of duty and under the Insolvency Act in respect of voidable preferences and transactions at an undervalue.
- Advising in the complex liquidation of a large Isle of Man trusts and corporate service provider enagings issues of corporate insolvency, trusts and property law.
- Applications to set aside statutory demands.
- Injunctions to restrain the presentation and advertisement of winding up petitions.
- Claims challenging reviewable or antecedent transactions.
- Bankruptcy petitions appearing for both creditors and debtors, and associated applications including for possession and sale.
- Validation orders.
- Winding up petitions, annulments, and rescissions.
- Extensions of administration.
- Applications by insolvency practitioners including applications for examination under s.236 of the Insolvency Act 1986.
- Applications to challenge the decisions of office-holders.
Company & Partnership
Millie regularly appears in the County Court and the Insolvency and Companies Court for various companies applications. Millie continues to develop and busy company and partnership practice, often dovetailing her insolvency practice.
Millie’s recent instructions include:
- Acting for the successful claimant in a contested claim for the rectification of a company’s charges register.
- Advising on the liability of salaried partners in an LLP.
- Advising on shareholders’ rights including unfair prejudice petitions.
Commercial Litigation
Millie has appeared in the County Court in various commercial disputes.
Her recent experience includes:
- Drafting a number of personal and corporate debt recovery claims.
- Unjust enrichment claims.
- Claims regarding aircraft leasing breaches.
- Contractual disputes including misrepresentation, mistake, undue influence, breach, estoppel.
- Assignment challenges.
- Loans, guarantees, and indemnities.
- Claims for breach of consumer rights and defective products.
- Successfully striking out a claim for breach of contract.
