Unless otherwise agreed between you and the barrister whom you are instructing, our members accept instructions on the basis of the Standard Contractual Terms For The Supply Of Legal Services By Barristers To Authorised Persons 2026 (Standard Terms). The Standard Contractual Terms were introduced on 31 January 2013. In 2018, clauses 6 and 7 were revised to align with the General Data Protection Regulation. In 2020, clause 4.3 was amended to reference the Money Laundering Regulations 2017. In 2026 clause 10 was retitled to liability “and insurance” to cover its contents, clause 10.1 was added to make clear the obligation on barristers to have insurance, clause 10.4 was added to reflect the £100,000 liability cap on the BMIF insurance in relation to purely contractual liability and clause 10.6 was added as an option for a barrister to limit their liability.

In an appropriate case, the barrister may be willing to act on alternative contractual terms, such as the COMBAR or CLLS terms.
