Roger Laville’s article on the Debt Respite Scheme (Breathing Space Moratorium and Mental Health Crisis Moratorium) (England and Wales) Regulations 2020/1311 was published in the December 2025 edition of the Butterworths Journal of International Banking and Finance Law.

The article considers the Regulations from the perspective of creditors, in particular secured creditors, and explores the practical difficulties that they have caused. It sets out a comprehensive survey of the reported decisions so far and highlights the issues which need to be considered when the Regulations are reviewed by the government in May 2026.
