Following the success of Michael Booth KC and Simon Adamyk in securing a multi-million pound judgment for the Claimant in a hotly-contested commercial dispute in Learning Curve (NE) Group Ltd v Lewis and Probert [2025] EWHC 1889 (Comm), Simon Adamyk, instructed by DWF Law LLP, again secured an excellent result on the consequential matters. The Claimant succeeded on every point in the face of continued substantial opposition.
In a judgment handed down on 3 October 2025 ([2025] EWHC 2491 (Comm)), the Judge:
(1) Ordered that the usual Part 36 consequences follow;
(2) Awarded the Claimant pre-Part 36 interest of 2% over base (as the Claimant sought) and post-Part 36 interest of 8% over base (again as the Claimant sought), including on costs;
(3) Awarded the Claimant the whole of its costs on the standard basis pre-Part 36, and on the indemnity basis post-Part 36;
(4) Awarded the Claimant the costs which had previously been reserved;
(5) Awarded the Claimant a payment on account of costs of £1,257,382 (100% of its budgeted costs);
(6) Awarded the Claimant the Part 36 additional amount of £75,000;
(7) Refused the Defendants’ application for permission to appeal; and
(8) Dismissed the Defendants’ application for a stay.
