Laura Webster’s Case Notes On Sullivan v Sullivan [2025] EWHC 1072 (Ch)

Laura Webster considers the recent decision of Sullivan v Sullivan [2025] EWHC 1072 (Ch) in which the court had to decide whether in the particular circumstances a declaration of trust should be rescinded on the grounds of mistake.  The decision is a useful example of the circumstances in which the court will consider there to be a “compelling” case for rescission, and it is an example of the dangers of not obtaining legal advice before executing documents in relation to valuable assets.
