Laura Webster considers the recent Court of Appeal decision of White v Alder [2025] EWCA Civ 392 in which the court had to decide whether a boundary demarcation agreement is binding on successors in title, including those whom purchase a property without any notice of the past agreement. The court’s decision delved into the public policy considerations and included an examination of the previous case law including the High Court decisions of Neilson v Poole (1969) 20 P&CR 909 and Gibson v New [2021] EWHC 1811.
