Laura Scanlon (née Webster) has written a case note examining the recent decisions in Rogers v Wills [2025] EWHC 1367 and [2026] EWHC 2231.
The case concerned a claim by a daughter who had provided care for her late mother for an extended period, seeking payment from her mother’s estate for the services provided.
The court found that an agreement had existed for the daughter to be paid a reasonable sum for her care. Following a separate hearing on quantum, the estate was ordered to pay £127,500 plus interest.
The judgments consider important issues surrounding contractual liability between family members, capacity to contract and unjust enrichment, including the principle of “free acceptance”. The decision also provides useful guidance on assessing reasonable compensation for care provided to family members.
