James Davies qualified as a Chartered Accountant before coming to the Bar. He specialises in company and insolvency law, utilising his accounting expertise in complex financial cases involving breaches of fiduciary duty, fraud, preferences and undervalued transactions. His work includes representing a liquidator in a Berkley Applegate order application for distributing client account funds, handling an appeal in Everitt v Budhram concerning the interpretation of 'needs' in the Insolvency Act and considering circumstances of the original bankruptcy order, successfully appealing an order for sale in Evans v Carter while addressing estoppel and unjust enrichment issues, and representing a trustee in bankruptcy in Singh v Hicken, appealing against a County Court's refusal to allow a discharged bankrupt to challenge the trustee's payment.
