In Hamblin v Moorwand LTD and RND Global Ltd, the claimants, victims of a scam, made innovative use of a derivative action to make a successful claim against a payment service provider in circumstances when the fraudsters had set up a company and directed  the victims’ monies to be paid into an account in the name of that company.

Mr Justice Marcus Smith found that the Defendant payment service provider had acted in breach of the duty of care explained by the Supreme Court in Philipp v Barclays Bank and ordered restoration of the company account.
